Lahore High Court Justice Mohsin Akhtar Kayani has resigned, citing health concerns and what he described as growing executive interference in judicial affairs following the 26th and 27th Constitutional Amendments.
In his resignation letter to President Asif Ali Zardari, Justice Kayani said the amendments had compromised the independence and institutional integrity of the high courts.
He also expressed concern that executive influence over judicial appointments and transfers had weakened public confidence in the justice system.
Justice Kayani said he had decided more than 23,000 cases during his judicial career, striving to uphold the Constitution, protect fundamental rights and administer justice without fear or favour.
He highlighted the difficulties faced by ordinary litigants, arguing that their needs had increasingly been neglected. Citing reasons of conscience, he said he could no longer continue serving on the bench under the prevailing circumstances.
The judge announced that he intended to return to legal practice to protect citizens’ rights and promote legal awareness.
Justice Kayani, known for rulings involving fundamental rights and enforced disappearances, was due to retire in 2032.
