US introduces new rules affecting international students’ stay

WASHINGTON: New US immigration rules for international students are set to take effect on Tuesday, replacing the longstanding “duration of status” system for F-1 visa holders with a fixed period of admission.

Under the new system, F-1 students will generally be allowed to stay for the duration of their academic programme listed on their Form I-20, for up to four years.

They will also receive 30 days to enter the US before their programme begins and another 30 days to leave after completing their studies or authorised post-completion training.

Students who require additional time to complete their programme, start a new course or undertake post-completion OPT or STEM OPT will need to take further steps to extend their stay.

They can apply for an extension through US Citizenship and Immigration Services (USCIS), or leave the US and seek a new period of admission through Customs and Border Protection (CBP) when returning.

The Department of Homeland Security has advised students to consult their college’s designated school official before seeking an extension.

Students applying for an extension must submit Form I-539 to USCIS after receiving the required recommendation on an updated Form I-20.
