SHC extends stay on CEO K-Electric removal after harassment probe

The Sindh High Court (SHC) extended the stay order in response to CEO K-Electric Moonis Alvi’s petition, which challenged the ombudsmen’s order in a case related to workplace harassment allegations made by his former female colleague.
Justice Muhammad Iqbal of SHC heard the petition of Moonis Alvi, pertaining to challenging the decision of the provincial ombudsmen about dismissing him from the post in the KE after he’d been found guilty in a harassment case.
During the court proceedings, the victim woman and the ombudsmen submitted their written responses in court.
Provincial Ombudsman declared Alvi’s petition non-hearable, stating that it should be rejected. He added that the petition related to the jurisdiction of ombudsmen is pending in the Supreme Court, and the SHC doesn’t have the authority to hear this case.

Petitioner's counsel, Abid Zubairi, informed the court that his client filed another petition to the Sindh governor, which will be heard on Monday.
Justice Iqbal remarked that “how can one be removed from office until the appeal is decided? We dismiss the case until it is decided by the governor of Sindh.”
“If the governor is hearing the case, then only he’ll pursue it; that was such a big conviction, how could we announce a sentence?” Justice inquired.
The petitioner's counsel said that “we are watching some of the things in this case for the first time, to which the chief justice replied that “many things have to be seen following the 26th Amendment”.
Later, directing Moonis Alvi's lawyer to submit a reply on the respondent’s response, the SHC restrained the removal of the CEO of K-Electric from his post with an extended stay order until September 12.

Earlier, the K-Electric CEO had submitted a fine of Rs2.5 million in the SHC in connection with harassment allegations brought against him by a former female colleague.
The fine, which was deposited on August 7, was mandated by the court and transferred to the SHC account at the National Bank.
Verdict
According to the ombudsperson’s order, Alvi was dismissed as the CEO of K-Electric under Section 4(4)(ii)(c) of the Protection Against Harassment of Women at the Workplace Act, 2010, and was removed from service with immediate effect.
Alvi was also ordered to pay Rs2.5 million as compensation to the woman within 30 days.
"If the accused failed to pay the fine amount within the stipulated period, the same shall be recovered as land revenue in terms of the Land Revenue Act, 1967, through the concerned Deputy Commissioner from the movable and immovable properties, including bank accounts of the accused," warned the ombudsperson.
"Furthermore, CNIC and Passport of the accused shall be blocked through NADRA and the Ministry of Interior till recovery of the fine."
Complaint
The complainant alleged that shortly after she joined K-Electric, while alone in the CEO's office, Alvi expressed a desire to take her out for dinner or coffee at night.
She further claimed that in June 2020, the accused made comments about her body and looked at her in a manner that made her feel uncomfortable.
She added that the accused frequently made remarks laced with sexual innuendos and maintained a pattern of inappropriate conduct.
“Even on weekends, particularly Saturdays, he would summon me to the office or arrange external meetings, leaving me with no days off,” she stated.
