Reference for interpretation of Article 63(A) approved by President Alvi
The reference regarding interpretation of Article 63(A) of the Constitution has been approved by the President Dr. Arif Alvi.
The President has approved to file a reference in the Supreme Court under Article 186 of the Constitution.
The President, on advice of the Prime Minister, has sought opinion of the Supreme Court on the aims and objectives of Article 63(A) of the Constitution, its scope and other related matters.
The reference has been filed in view of the news of dissident members of Parliament for No-Confidence motion.
Federal Minister Fawad Chaudhry had also clarified this in a message.
“Government has decided that a reference under Article 186 would be filed in the Supreme Court for the interpretation of Article 63-A.” He said.
He added that in this reference, the opinion of the Supreme Court would be sought as to what would be the legal status of their vote when members of a party were explicitly involved in horse trading and exchanged allegiances for money.
He said the reference would ask whether members who change their allegiances for economic gain would be disqualified for life or would be allowed to participate for re-election.
Fawad Chaudhry said that a request would be made to the Supreme Court to hear this reference on a daily basis and give a verdict.
