Petition filed to declare Transgender Act 2018 against Shariah

A man on Thursday filed a petition in Lahore High Court (LHC) to declare Transgender Act 2018 against Shariah.

It has been argued by the petitioner that the provisions of the Transgender Act 2018 are contrary to Islamic teachings and laws, Therefore the act should be declared against Shariah.

Earlier, Jamiat Ulema-e-Islam-Fazl (JUI-F), an ally of the government and part of the Pakistan Democratic Movement (PDM), has challenged the Transgender Protection Act, 2018, in the Federal Shariat Court (FSC) on Friday.

The Council of Islamic Ideology (CII) has also said that several provisions in the Transgender Persons (Protection of Rights) Act are not in line with Shariah and may lead to ‘new social problems’.

Later, The National Database and Registration Authority (NADRA) on Tuesday decided to cancel Rule 13-1 for gender reassignment.

The bill:

The Transgender Persons (Protection of Rights) Act was passed by National Assembly in 2018 during PML-N’s administration.

The law prohibits discrimination against transgender people in schools, workplaces and public spaces, as well as ensures their right to vote, inherit property and run for public office.
