Khyber Pakhtunkhwa Narcotics Act 2019 challenged in Peshawar High Court

PESHAWAR: Khyber Pakhtunkhwa Narcotics Act 2019 has been challenged in the Peshawar High Court (PHC) on Monday.

A writ filed in the high court has demanded to declare the Act unconstitutional for it repealed the option of filing bail petition in the subordinate court.

“The government has revoked the Narcotics Act 1997 and the new act does not have a procedure for a bail as the authority of granting bail has been withdrawn from the lower courts under the new act,” said the petitioner.

The complainant said the new law was a hurdle in provision of swift justice. Trial court judges should be allowed to hold hearing into the bail applications, the writ demanded.

Lawyers have been protesting against the Narcotics Act for one week.
