Investigations against Justice Faiz Issa conducted in wrong way: Supreme Court

ISLAMABAD: The Supreme Court (SC) has issued a written verdict in the review case of Justice Qazi Faiz Issa. The verdict said that the investigation against Justice Faiz Issa was conducted in a wrong way. Accountability of the judiciary is necessary but it should be in accordance with the law.

The decision was written by Justice Maqbool Baqir, Justice Mazhar Alam, Justice Mansoor Ali Shah and Justice Aminuddin. Justice Yahya Afridi wrote an additional note.

The Supreme Court had given a brief verdict on April 26, 2021. A ten-member larger bench ruled in favor of Serena Issa by a margin of four by six.

According to the decision, the review petitions of wife Serena Issa were approved by a majority. Every citizen has the right to be treated in accordance with the law of his life, liberty, reputation and property.

The decision further stated that Articles 9 to 28 of the Constitution protect the fundamental rights of every citizen and if a citizen is a public office holder then he is also protected by law. The verdict announced in clear terms that no one, including the judge of this court, is above the law. On the other hand, no one, if he is judge of this court, can be deprived of his legal rights.
