DI Khan woman gets her share in inherited property after 46 years

A woman named Zaitoon Bibi, hailing from Dera Ismail Khan (DI Khan), finally received her share of the inherited property after 46 years of litigation.
After the death of her father, the brothers have occupied the property of the sisters since 1976. Zaitoon Bibi filed a case in the civil court in 2005 for a share in the property.
The Supreme Court of Pakistan (SCP) quashed the appeal of her brothers against the earlier decision of the Peshawar High Court (PHC).
In the Supreme Court, a three-member bench headed by Justice Ijaz-ul-Ahsan heard the appeal of the brothers against the decision of the Peshawar High Court that the woman Zaitoon Bibi inherited her father’s property.
The petitioner’s counsel said that the sisters had gifted their share to the brothers. On this, Justice Ijaz-ul-Ahsan remarked that the sisters were young at the time when they gifted.
“How can a young sister gift the property to the brothers? Have brothers ever gifted property to a sister? Why should the sister give a gift every time?” Justice Ijaz-ul-Ahsan remarked.
Justice Muneeb Akhtar said that, “when the sister was a minor, how did the brothers take all the property from the sister?”
“A minor sister cannot enter into any contract,” ruled Supreme Court after rejecting the appeal of the brothers against the Peshawar High Court’s decision.
